Effective Date: 1 October 2025

This Host Policy (“Policy”) establishes the rights, obligations, and responsibilities of individuals or entities (“Hosts”) who list and manage spaces, services, or experiences (“Listings”) on the Spixy platform (“Platform”). This Policy is legally binding on all Hosts and forms an integral part of the Spixy Terms of Service.


1. Eligibility and Host Obligations
All Hosts must be at least eighteen (18) years of age and possess the legal capacity to enter into binding contracts. Hosts are solely responsible for ensuring that they hold all ownership rights, lease rights, licenses, permits, and authorizations required to list, operate, and monetize their Listings on Spixy.

Hosts must obtain and maintain all registrations and licenses mandated by Indian law, including but not limited to:

  • Shop and Establishment Registration;

  • Goods and Services Tax (GST) Registration, if applicable;

  • Trade Licenses, wherever required;

  • Fire and Safety Clearances, if applicable; and

  • Any other regulatory approvals prescribed by municipal, state, or central authorities.

Hosts shall remain fully responsible for fulfilling all tax obligations, including income tax, GST, withholding tax, and any other levies imposed under applicable law. Non-compliance with tax or regulatory requirements will be treated as a material breach of this Policy.


2. Creation and Management of Listings
Hosts are required to provide accurate, complete, and up-to-date information when creating Listings, including but not limited to descriptions, amenities, media content, and pricing. All Listings must disclose:

  • Any risks inherent in the space or service;

  • Any participation requirements such as age limits, skills, or fitness levels;

  • Any safety instructions, dress codes, or equipment requirements; and

  • Any licenses, permits, or certifications applicable to the service being offered.

Listings must not misrepresent or conceal material information. Hosts remain fully responsible for all information they publish, irrespective of whether third-party services or automated tools are used to prepare Listings. Misrepresentation may result in removal of the Listing, suspension of the Host account, or termination from the Platform.


3. Prohibited Services and Activities
Hosts are expressly prohibited from:

  • Offering accommodation or lodging services of any kind, unless explicitly authorized by Spixy in writing;

  • Listing or providing any services, experiences, or goods that are illegal, banned, or restricted under Indian law;

  • Facilitating gambling, betting, or similar activities;

  • Supplying alcohol, narcotics, or controlled substances without required government authorization;

  • Offering Listings that violate municipal zoning laws, land-use restrictions, or public order; and

  • Engaging in activities that compromise public morality, decency, or safety.

Any Listing found to be in violation of these prohibitions will be removed immediately, and the Host’s account may be terminated without notice.


4. Host Content Rights and Permissions
By uploading content such as images, videos, or descriptions to the Platform, Hosts grant Spixy a non-exclusive, royalty-free, worldwide license to use such content for marketing, promotional campaigns, advertising, and for publication across Spixy’s websites, applications, partner networks, and social media platforms. Spixy commits to using this content fairly and without misrepresenting the Host’s offerings.

Hosts are responsible for securing all permissions, licenses, and releases from third parties featured in their content, including names, likenesses, voices, and intellectual property rights.


5. Hosting Standards and Conduct
Hosts must ensure that their spaces and services are safe, clean, and fully prepared for Guest use. Check-in and check-out details, including access instructions, must be clearly communicated. No Guest may be allowed access without a confirmed Spixy booking. Hosts must verify Guest booking PINs at the time of service.

Hosts are expected to treat Guests with respect, professionalism, and fairness. Any form of harassment, abuse, discrimination, fraudulent misrepresentation, negligence, or unlawful conduct is strictly prohibited and may result in termination of hosting privileges.


6. Equipment and Facilities
Hosts are responsible for providing and maintaining all equipment, supplies, and facilities required for their Listings. All such equipment must be safe, functional, and compliant with safety standards and inspection requirements. The Host assumes full risk of loss, theft, or damage to equipment unless otherwise required by law.


7. Cancellations and Refunds
Guests are entitled to a full refund if they cancel a booking before the Host has accepted it. Once a booking is accepted, refunds will not be issued. If a Host cancels or fails to honor a confirmed booking, the Guest will receive a full refund, and the Host may face penalties, suspension, or account termination.


8. Additional Host Responsibilities
Hosts must comply with all applicable municipal, state, and national laws relating to their Listings. This includes maintaining licenses, paying applicable taxes, and adhering to labor, safety, and environmental laws.

Hosts must also:

  • Provide proof of licenses, permits, or insurance upon request;

  • Ensure all spaces and common areas remain in proper condition;

  • Bear responsibility for damages or violations arising from their acts or omissions; and

  • Accept liability for the conduct of employees, contractors, or representatives operating under their authority.

Failure to comply with these obligations will constitute a breach of this Policy.


9. Insurance and Liability
Hosts are encouraged, and in some cases required, to obtain insurance policies adequate to cover potential liabilities associated with their Listings. Coverage must comply with applicable laws and protect both Hosts and Guests. Proof of insurance may be requested by Spixy prior to activation or at any point during the hosting period.

Hosts remain fully liable for any claims, damages, injuries, or losses arising from their Listings.


10. Intellectual Property and Publicity
Hosts may not use Spixy’s name, trademarks, or branding without written authorization. Any public communications or promotional activities implying endorsement by Spixy must be pre-approved in writing. Unauthorized use of Spixy’s intellectual property will be treated as a violation of this Policy.


11. Suspension and Termination
Spixy reserves the right to suspend or permanently terminate a Host’s account without prior notice if:

  • The Host breaches this Policy or any applicable law;

  • The Host fails to maintain licenses, registrations, or tax compliance;

  • The Host engages in unsafe, fraudulent, or unlawful conduct; or

  • The Host fails to honor confirmed bookings without valid justification.

Hosts may voluntarily terminate their participation on the Platform by removing their Listings or notifying Spixy in writing.


12. Hosting as a Team or Organization
Where Listings are operated by a team or organization, all individuals interacting with Guests must be registered with Spixy and subject to verification. Hosts remain liable for the conduct of their representatives.


13. Governing Law and Enforcement
This Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising under this Policy shall be resolved as per the Dispute Resolution clause of the Spixy Terms of Service.

Indemnification Clause
Hosts shall indemnify, defend, and hold harmless Spixy (its officers, directors, employees) from any claims, damages, losses, liability, or actions (legal or regulatory) arising out of or in connection with the Host’s breach of this Policy, or the Host’s negligence, willful misconduct, or failure to obtain the necessary legal, licensing, or tax compliance.

Limitation of Liability
To the extent permitted under law, Hosts shall limit Spixy’s liability for issues arising from Listings, including misrepresentations or service failures, provided that Spixy has not acted negligently or unlawfully.

Severability
If any provision of this Policy is held invalid or unenforceable by a competent court or regulatory authority, the remainder of the Policy shall continue in full force and effect, with the offending provision modified to the minimum extent necessary to achieve compliance.

Changes to Policy
Spixy reserves the right to update, modify or amend this Policy. Changes will be effective upon posting on the Platform or by notifying Hosts. Hosts’ continued use of the Platform after such updates constitutes acceptance. Spixy may in certain circumstances require Hosts to expressly re-accept the Policy.

Personal Data Handling
Hosts must comply with applicable data protection laws (including the Digital Personal Data Protection Act, 2023, when enforced), and related rules. This includes obtaining necessary consents for collection/use/disclosure of Guest personal data, ensuring secure retention, secure disposal, and not using Guest data for unauthorized purposes.

Security Measures
Hosts must implement reasonable technical and organizational measures to protect their systems, facilities, and data from unauthorized access, cyberattacks, data breaches, and other threats. Hosts should notify Spixy and affected Guests in case of any security breach impacting personal data or Guest safety, in line with applicable law.

Grievance Redressal & Cooperation with Authorities
Hosts must cooperate with Spixy in responding to complaints or notices from governmental or legal authorities; this includes providing information, records, or access as required under law. Hosts shall maintain records (bookings, guest identities, correspondence) for a period as required under applicable law to support investigations or audits.
