No Show Incentive Policy
Effective Date: 1st October 2025
These No-Show Incentive Policies set out the framework under which hosts may be considered for discretionary incentives in the event of guest no-shows for confirmed bookings made through the Spixy platform (the “Platform”), operated by Nexxuscore Global Solutions LLP.
1. Scope and Applicability
This No-Show Incentive Policy (“Policy”) governs the conditions under which Spixy Technologies Private Limited (“Spixy”, “we”, “us”, or “our”) may, at its sole discretion, extend an incentive to eligible hosts (“Host”, “you”, or “your”) in connection with certain confirmed bookings where the guest does not appear as scheduled.
This Policy forms an integral part of the Spixy Terms of Service and must be read in conjunction with all applicable platform policies, guidelines, and agreements.
2. Nature of the Program
The no-show incentive program is a voluntary, discretionary, and goodwill-based initiative.
For the avoidance of doubt:
Spixy does not guarantee, insure, compensate, or indemnify Hosts for any loss, damage, opportunity cost, or business impact arising from a guest no-show.
Participation in this program does not create any contractual entitlement, vested right, or legitimate expectation of payment.
Spixy assumes no liability for host losses arising from booking cancellations, no-shows, or guest behavior.
3. No-Show Determination
A booking may be considered a “No-Show” solely at Spixy’s discretion if all of the following conditions are satisfied:
The booking was validly confirmed on the Spixy platform.
The guest failed to check in within the designated time window.
No valid cancellation or rescheduling was recorded within the permitted timeframe.
Host availability and operational readiness are verifiable.
Spixy’s determination of no-show status shall be final and binding.
4. Incentive Assessment
Any incentive amount, methodology, limits, or conditions shall be communicated separately to Hosts and may vary by category, booking type, demand conditions, and risk profile.
Spixy reserves the unrestricted right to approve, modify, cap, defer, suspend, or decline any incentive request without assigning reasons.
Incentives may be issued partially or not at all, regardless of prior practice or historical outcomes.
5. Eligibility Requirements
To be considered for any no-show incentive, Hosts must:
Maintain accurate listings, pricing, and availability.
Comply with all platform policies, onboarding declarations, and operational standards.
Provide timely and truthful information in connection with the booking and any verification requests.
Failure to meet eligibility requirements shall result in automatic ineligibility.
6. Compliance, Audits, and Disqualification
Spixy conducts continuous and concurrent internal audits to safeguard platform integrity.
Hosts shall be immediately disqualified from no-show incentive consideration if Spixy identifies, at its sole discretion:
Misrepresentation, suppression, or falsification of information.
Booking irregularities, abnormal patterns, or systemic abuse.
Suspected or confirmed fraud, collusion, or manipulation.
Material defects, compliance failures, or violations of platform terms.
Spixy may suspend, terminate, or permanently restrict access to the incentive program or the platform itself without notice or liability.
7. Settlement and Accounting Treatment
Approved incentives, if any, are processed as non-revenue goodwill credits.
Settlement timelines and payout methods are determined exclusively by Spixy.
Spixy shall not be liable for delays arising from verification, audits, disputes, technical issues, or force majeure events.
8. No Waiver and Reservation of Rights
Nothing in this Policy shall:
Constitute a waiver of Spixy’s rights under applicable law or contract.
Limit Spixy’s right to recover dues, offset amounts, or enforce platform terms.
Create any partnership, agency, employment, or fiduciary relationship.
Spixy expressly reserves all rights, whether expressly stated or implied.
9. Amendments and Termination
Spixy may amend, replace, suspend, or discontinue this Policy at any time without prior notice. Continued use of the platform constitutes acceptance of the updated Policy.
10. Governing Law
This Policy shall be governed by and construed in accordance with the laws of India. Courts having jurisdiction over Spixy’s registered office shall have exclusive jurisdiction.
